License Agreement ("the small print")

License Agreement for Limited Royalty Free Stock Photographs provided by PICSANDLIGHT.COM and Peter Truman.

All images sold via PICSANDLIGHT.COM are limited royalty free. That means you can use them in almost any way you like for a period of one year subject to the terms and conditions of this License Agreement. In addition you may not resell any Image.

The following is a legal Agreement between you (the "Licensee") and PICSANDLIGHT.COM (the "Image" or "Images"). Please read this Agreement carefully before purchasing or downloading any images. By using any image, you agree to be bound by this Agreement. If you do not agree to this license agreement you must not download and use any Image.

1. All Images on the PICSANDLIGHT.COM website are protected by United Kingdom and international copyright laws. PICSANDLIGHT.COM and Peter Truman own all rights, including the copyrights in and to the Images. PICSANDLIGHT.COM and Peter Truman reserve all rights in and to the Images not expressly granted to you by the terms of this license. Your rights to use any Image are subject to this license agreement and are conditional upon your payment to PICSANDLIGHT.COM and Peter Truman for your use of the Images.

2. By this Agreement, PICSANDLIGHT.COM grant you a personal, non-exclusive, non-transferable, right to use and reproduce Images in the following ways, subject to the limitations set forth herein and in section 6 below:

a) On web sites, provided that no Image is displayed at a resolution greater than 800 x 600 pixels;

b) In printed materials as part of advertising or editorial copy in magazines, newspapers, books, book covers, textbooks, editorials and directories;

c) In artwork for product packaging including CD or DVD cover art;

d) On letterheads and business cards, brochures and other marketing or promotional materials for use in shops, offices and trade shows, but not where these marketing or promotional materials are resold (such as paid-for product catalogues);

e) On posters promoting the sale of other products, but not promoting the sale of products including the Images;

e) In eBooks or incorporated into other software provided that the Image or any files incorporating the Image can be unincorporated from the software;

f) In multi-media presentations or training materials.

3. You may you create a derivative work based on or incorporating one or more Images, but all rights in and to such Images shall continue to be owned by PICSANDLIGHT.COM and Peter Truman.

4. Your use of Images is not limited by the number of items produced, published, circulated or sold except as set out in section 6 below.

5. You may only use the Images as set out in section 2 above, provided all other conditions are met including section 6 below, for yourself, your employer, direct client or customer.

6. This agreement specifically does not permit you to:

a) Loan, rent, lease, sub-license, sell or otherwise transfer the right to use any Images except where they have been incorporated by you into works as in section 2 above;

b) Use any image with any form of pornography, defamatory, illegal or immoral content or in a manner that infringes any other trademark or intellectual property;

c) Distribute the Image through any printed or on-line media except as expressly permitted herein;

d) Use any Image or portion thereof in any trademark or service mark;

e) Claim any rights in any Image or portion thereof;

f) Use any Image in any way with the intent to promote a business that is an image provider;

g) Use any Image in any way with the intent to promote a political party or political endorsements, tobacco products, pornographic and/or "adult entertainment" products and/or services;

h) Use any Image in a greeting card (printed or electronic), postcard or similar for resale or any other commercial purposes. Greeting cards produced for personal use and not resold are permitted where their circulation is less than 250.

7. Terms. This License is effective for a period of one year from the date you pay the licensing fee. Subsequent use of the Image requires a new payment and license agreement. You can terminate this license early by destroying the Image, along with any copies or archives of it or accompanying materials (if applicable), and ceasing to use the Image for any purpose. If you terminate the license early you will not receive a refund. The license also terminates if at any time you fail to comply with the terms of this Agreement. Under such circumstances you hereby agree to destroy all copies and archives of the Image, to cease using the Image for any purposes, and to confirm to PICSANDLIGHT.COM in writing that you are compliant with these requirements.

8. Any publication right (as defined in the Copyright and Related Rights Regulations 1996) arising from your use of any Image shall vest in PICSANDLIGHT.COM and Peter Truman and you hereby assign all such rights arising to us.

9. When you use an Image licensed from PICSANDLIGHT.COM you agree to include a credit with any use of the Image. This should appear adjacent or close to the use of the Image and must include "© Peter Truman, PICSANDLIGHT.COM". Where a publication uses an acknowledgements or credits page, you agree to include such a credit.

10. Neither PICSANDLIGHT.COM or Peter Truman shall be liable for any loss or damage suffered by you or by any third party arising from the use of any Image or other information. Damages for any other breach shall be limited to the licensing fee paid by you.

11. This License Agreement shall be governed by the laws of England and Wales and the parties agree to submit the jurisdiction of the English courts, such jurisdiction to be exclusive, save for infringement of copyright or non payment of our invoices where it will be non-exclusive.
